-4- <br />10. PT ease address concern No. 8 on Ms. Anne Baldrige's memorandum of <br />March 3, 1986. <br />I1. From the recently submitted information, we are unable to determine the <br />map that is to comply with the hydrology requirements of Rules 2.04.5 <br />and 2.04.7. Please either specify which of the new maps represents the <br />hydrology concerns or submit the required map to comply with these <br />rules. <br />12. Prior to the construction of the sediment pond and any of the diversion <br />ditches in previously undisturbed areas, Blue Flame must salvage all <br />available topsoil medium. This medium will then need to be stockpiled <br />with a collection berm constructed around the perimeter of the <br />stockpile. Also, the stockpile will need to be vegetated to reduce <br />wind and water erosion. Blue Flame should commit to these items, <br />depict the location of the topsoil stockpile on Map 1, and specify the <br />seed mixture to be used to vegetate the stockpile. <br />2.04.11 Fish and Wildlife Resource Information <br />As requested in our earlier adequacy letter, "Please submit the Wildlife <br />Inventory Statement from the Division of Wildlife...". <br />2.04.12 Prime Farmland Investigation <br />1. The Division is unclear of any "...new federal coal lease..." that Blue <br />Flame is obtaining as alluded to in the first paragraph of this <br />exhibit. It is the Division's understanding that the coal to be mined <br />is privately awned by the Lobato's. Please address this issue. <br />2. Pursuant to Rule 2.04.12(3), Blue Flame needs to submit ..a request <br />fora negative determination which concludes that the land meets one of <br />the criteria of 2.04.12(2)" specifying which, if any, of the <br />determinations of this rule that are applicable. <br />2.05.2 Operation Plan - Estimated Area for Life of Operations <br />1. Concern no. 2 of our first adequacy letter raised a number of issues of <br />which only the anticipated annual and total tonnage was addressed. <br />Blue Flame needs to address the outstanding issues raised in concern 2 <br />of our March 3rd correspondence. <br />2. From a review of the Mine Plan View, it is unclear what areas are <br />proposed to be mined during the term of this permit. Please address <br />concern 3 of our March 3rd correspondence. <br />
