Rule 2.03 Legal, Financial, Compliance and Related Information <br />The Division has become aware of changes in land ownership since the application <br />materials were created. Please review county real estate records for ownership changes <br />and make the necessary corrections to Map 1 and the permit text. Secondly, ownership of <br />the surface and coal is not clearly and accurately identified on Map 1, Land Use. The <br />permit text states that "unless otherwise noted, rights include both surface and minerals ". <br />In that case, the Zak parcel is to be mined yet they are not listed as mineral owners. <br />Finally, the permit text refers to coal ownership within the permit boundarv on page 2.03-5 <br />but the Popkess-Yawter (Karki and Klavetter on Map 1) is not listed as a mineral owner. <br />Please review the requirements of Rule 2.03.4(6) and Rule 2.10.3(1)(a) and mods Map 1 <br />and the permit text to accurately, clearly, and distinctly depict the ownership of all coal to <br />be mined and the surface ownership within the permit boundary and adjacent to the permit <br />boundary. <br />Northfield Response: Edits were made to Map 1, permit text and Exhibit B (unlabeled). <br />DRMS response: Changes to Map 1, Land Use were noted including the addition of surface <br />and coal rights as symbols in addition to structures within 1000 feet of the permit boundary <br />as described in permit text under Rule 2.03.4. However, boundaries dividing ownership are <br />not clear and do not allow a precise determination of ownership. Exhibit B information <br />(two pages, unlabeled) does not accurately reflect the permit boundary and therefore cannot <br />accurately reflect ownership contiguous to that boundary. The street address for Gilliam <br />is different on page 2.03-6 and Exhibit B. The Cotter Corporation address is different <br />on page 2.03-6 and Exhibit B. Please review the requirements of Rule 2.03.4(6) and <br />Rule 2.10.3(1)(a) and modify Map 1 and the permit text to accurately, clearly, and <br />distinctly depict the ownership of all coal to be mined and the surface ownership <br />within the permit boundary and adjacent to the permit boundary. Boundaries <br />separating ownership are difficult or impossible to determine at this time. <br />4. Permit text indicates a house on the Klavetter/Karki parcel (now Popkess-Vawter) but none <br />is shown on Map 1. (Rule 2.10(1)(d)). Also, some buildings may have been constructed <br />since Map 1 information was complied (see Ravensberg parcel). Please update this <br />important information on maps and in permit text. <br />Northfield Response: Additions were made to Map 1 regarding structures. <br />DRMS response: Response accepted. <br />5. Please update the permit text with the MSHA identification number. <br />Northfield Response: Coal operator is undetermined at present time. <br />DRMS response: Please submit the appropriate permit page when MSHA number is <br />known. <br />
