Maos - Rule 2.10 <br />1, There is some question regarding the permlt boundary. The maps include <br />the tipple area and lands released from bond within the permlt boundary. It <br />1s the Division's understanding that the tipple was to be permitted <br />separately. Lands released from bond are not under the Division's <br />Jurisdiction and do not fit into the permlt area definition (Rule 1.04). <br />Please provide the legal description for the permit area. MaDS not showing <br />the correct permit boundary will have to be changed. <br />Land Use - Rules 2.04.3, 2.05.5. and 4.16 <br />1. CYCC has designated the maJor land use category within the permit area to <br />be pastureland. Lands designated by this category are characterized by big <br />sagebrush, snowberry and various native grass species. This vegetation type <br />1s not usually associated with land that is actively managed for grazing, <br />browsing or for occasional hay production as required by the pastureland <br />definition (Rule 1.04(11)(b). CYCC has made reference to the active <br />management of the native Dastureland but there 15 no discussion describing <br />what those management practices are. Please discuss to detail the methods by <br />which the native pasturelands are actively managed. If management 1s <br />primarily achieved by regulating the intensity of grazing, season of use or <br />brush control, the areas may be better designated as rangelands. <br />Geologv - Rules 2.04.5 and 2.04.6 <br />1. Dr111 hole logs are presented in Exhibit 1. A number of logs for monitor <br />wells that are Included 1n the applicant's Hydrologic Monitoring Plan (Exhibit <br />15, Table A) are not contained in Exhibit 1. Specifically, driil hole logs <br />for the following monitor wells are missing: 77-35; 77-42; 77-43; 79-6; 19-7; <br />and AX-1. Drill hole logs for these monitor sites should be included to <br />Exhibit 1. <br />Hvdrologic Balance - Rules 2.04,5. 2.04.7, 2.05.3(4). 2.05.6(3) and 4.05 <br />A. Ground Water Information <br />1. The potenttometric surface of the overburden and alluvial aquifers in the <br />permit area are presented on Map 4, Mtne No. 3 Hydrology. These contours were <br />drawn based on October 1980 water level data. The map does not depict <br />overburden ground water gradients 1n the area of the Middle Creek Pit or north <br />of the Dit within the permit area. Mhy vasn't water level data from Monitor <br />Well 008-80-8 8n the Lleske Yldll used to construct this map? The <br />potentiometric surface map should be revised to include water level data from <br />all available bedrock and alluvial monitor wells. ~~iu ~pau~-w~ ~~~3 C~~ <br />2. Ground water quality data from the Droposed permit area are presented in <br />Tables 26 and 30 of the permit application. The data presented in these <br />tables do not reflect the total ground water sampling and analysts effort ~, ~e-~ <br />conducted to date at the Energy Mine Ho. 3 site. Additional historic data for e <br />both bedrock and alluvial monitor wells is contained 1n Tables 26 and 30 of ~ X05, <br />the original Energy Mine No. 3 permit application submitted by Energy Fuels Ul <br />Corporation in February, 1981 (CMLRD file No. C-03f~81). <br />
