Box 774288 <br />Steamboat Springs, Colorado 80477 <br />Re: Energy Mtne No. 3; File No. C-84-062 <br />Adequacy Review <br />Dear Mr. McMtndes: <br />DIVISION <br />The above-referenced permit application has been reviewed by the Division of <br />Mined Land Reclamation for compliance with the regulations promulgated <br />pursuant to the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 <br />et seg. This letter and attached comments convey the concerns raised during <br />the adequacy review as required under Rule 2.07.4(1). Additional information <br />may be requested as the review continues. <br />The major deficiencies identified during the adequacy review are related to: <br />land use, hydrology, soils, backf1111ng and grading, and permanent <br />impoundments. Additionally, there is some confusion over what the exact <br />permit boundary of the Energy Mine No. 3 is. A legal description of the <br />permit boundary will be required. The permit boundary, as it appears on the <br />majority of the maps, includes the tipple 3 area. <br />I suggest ve have a meeting as soon as possible to discuss any questions you <br />have concerning this review.
