-4- <br />9. Please discuss in more detail the well driven on the mine bench near the <br />water tank as discussed on page 4 of exhibit E. <br />10. Please provide a copy of Blue Flame's Nation Pollution Discharge <br />Elimination System Permit or application for permit. <br />11. Please provide a map of the geology and hydrology of the permit area and <br />the general area, as requested pursuant to Rule 2.04.5, 2.04.6 and 2.04.7. <br />2.04.6 Geology Description <br />1. There seems to be a discrepancy pertaining to the lower coal seam as <br />discussed on page 2 of Exhibit D. The first paragraph states "Two coal <br />seams are exposed on the property..."; whereas, the second paragraph <br />specifies "The lower seam is not exposed". Please provide more <br />information about this lower coal seam (eg.: exposure, relation to upper <br />seam, etc.). <br />2. Please provide Mr. Gaskill's geologic hazard report as briefly referenced <br />on page 7 of Exhibit D. <br />2.04.7 Hydrology Description <br />Blue Flame should commit to monitor both up-and down-stream of the mine the <br />water quantity and quality. Such monitoring is need to verify Blue Flame's <br />claim that the proposed coal mining activities will not have an impact on <br />surface water. The water quality parameters that should be measured on a <br />quarterly basis can be found on page 67 of the Rules and Regulations. <br />2.04.9 Climatological Description <br />The table on page 2 of Exhibit F that depicts "Average Precipitation (in)" <br />from the Fort Lewis Station data are missing for January. Please submit a new <br />table with these missing data incorporated. <br />2.04.9 Soils Information <br />1. Page 1 of Exhibit G references Map C-6 and an accompanying photo of the <br />mine site. We are unable to locate either the map or the photo. Please <br />submit these specified items. <br />2. Page 2 of Exhibit G portrays the typical pedon for the "XMO-F-Lazear-Rock <br />Outcrop Complex, 12 to 65 percent slopes". Unfortunately, this pedon <br />does not depict the top four inches. Please submit the information <br />pertaining to this pedon for zero to four inches. <br />3. Much of the section entitled "Reclamation Top Soil" (pages 9-12 of <br />Exhibit G) is representative of the National King Coal site and not the <br />Blue Flame site. The Division suggests that Blue Flame contact the local <br />Soil Conservation Service representative to obtain site specific <br />information. The Division is concerned that Blue Flame may be committing <br />to items that are not representative of the site. <br />
