The statement on Page II-91 that no surface coal mining is <br />within 100 feet of the outside right-of-way of any public <br />highway appears incorrect; the refuse pile is within Z00 feet. <br />The requirements of 30 CFR 761.12 should be addressed. <br />C. Surface Disturbance Area <br />1. The rock dust tank for the Eagle #9 mine has not been included <br />in the surface disturbance area. <br />2. The ownership of the access road between the Eagle #9 mine and <br />the shop area should be specified. If this road is public, <br />maintenance responsibility should be identified. If parts of this <br />road are private and/or Empire has responsibility for road <br />maintenance, the applicable parts of the road should be included <br />within the surface disturbed acreage. If the current access road to <br />.the No. 2 mine is to be used as access to the Eagle #9A mine, this <br />road must be included within the disturbed area. <br />There is a discrepancy in lease boundaries between Map III-3 and <br />Map IV-9. Specifically in the 2E-3R area. Map III-3 shows Federal <br />coal to the south edge of the panel. Map IV-3 shows the south edge ~ <br />of the Federal lease boundary 900 feet north. Please clarify. ' <br />IZ. Part III -Environmental Resources Information <br />A. Archeological Resources <br />The staff is soliciting comments from the State Archeologist. Their <br />comments will be forwarded to you when available. <br />B. Acid and Toxic Materials <br />Table III-2 only provides chemical information for the "P" seam. <br />No roof and floor chemical analysis has been provided for the "F" <br />seam. Roof and floor analysis for the "F" seam must be provided. <br />C. Use of Groundwater and Alternative Water Supply <br />The State Engineer's office is reviewing these sections of the <br />application.
