Pursuant to the request of Darry Ferguson, the staff Has <br />reviewed this application with respect to the Office of Surface Mining <br />Final Regulatory Program and applicable Colorado Regulations. Because <br />of the complexity of this review and the logistics of coordination, <br />this review does not include comments from the State Engineer's Office, <br />the Colorado Division of Wildlife, the Colorado,State Archeologist, and <br />comments from the Division's geomorphologist, and geotechnical specialist. <br />These comments will be forwarded to Empire Energy when available. <br />This adequacy review reveals two types of deficiencies. The first type <br />are minor errors, inconsistencies, typographic errors and unclear state- <br />ments. The second type of deficiency is numerous significant issues of <br />concern. This review will proceed detailing all deficiencies in the order <br />the material appears in the application. Response to the below issues <br />should be addressed in the form of revised pages. <br />I. Part II - Legal, Financial, Compliance Infromation <br />A. Legal right to enter and mine plan approval. <br />1. The applicant should include copies of recorded lease agree- <br />ments with Moffat County ar)d BIM to demonstrate legal right to <br />enter in Federal leases D-056298 and C-0126980. <br />2. The Moffat County Approval for a 360 acre addition in Appendix <br />11-3, does not include the addendum referenced in Item q5 of the form <br />which provides the legal description of this 360 acres. This <br />addendum should be provided. Currently, local government approval <br />does not include activities in Section 30. <br />. .U <br />(cont'd) <br />
