At the time of final program <br />submission, approved procedures will be followed in revisiting this <br />issue. With respect to compliance with 761.12(d), it is the staff's <br />position that this requirement has no[ yet been satisfied and will need <br />to be re-evaluated at the time of final program submission. <br />II. Environmental Resources Information (Section 2 of the application) <br />30 CFR 783 - State equivilent Proposed Rule 2.04. <br />1. Section 3.1.1 - Size, Sequence and Timing of Mine Plan Area is <br />in compliance with final regulations. <br />2. Section 3.1.2 - Archeological Resources. <br />This section was not reviewed with respect to the requirements <br />under the final regulations. In addition, the State Archeolo- <br />gist's Office, to date, has not reviewed this material nor pro- <br />vided their opinion to the Division. <br />3. Section 3.2 - General Description of Hydrology and Geology is <br />in compliance with the final regulations. <br />4. Section 3.3 - Geology of the Mine Plan Area is in compliance <br />with the final regulations. <br />5. Section 3.4 - Groundwater Resources <br />In principle, [he information presented in this section is in <br />compliance with the final regulations. Bedrock and alluvial <br />groundwater monitoring wells have been established to gather <br />baseline groundwater data and this information will need to be <br />supplied at the tune of re-permitting. <br />6. Section 3.5 - Surface Water Resources. <br />In principle, the information presented in [his section is in <br />compliance with the final regulations. Again, data from surface <br />water monitoring points will need to be supplied at the time of <br />re-permitting. <br />7. Section 3.6 - Alternate Water Supply. <br />This section was reviewed witfi respect to the interim regulations. <br />The hydrologic monitoring data being gathered this year should <br />allow for better evaluation of the concerns of this section of <br />the regulations at the time of re-permitting. <br />8. Section 3.7 - Climatological Factors are in complanace with the <br />final regulations. <br />9. Section 3.8 - Vegetation Description. <br />This section was only reviewed with respect to the interim regu- <br />lations. Additional site-specific vegetation baseline work will <br />be required under the final program. <br />10. Section 3.9 - Fish and Wildlife Resources Information is in compli- <br />ance with the final regulations. <br />11. Section 3.10 - Soils Inventory is in compliance with the final <br />regulations. <br />12. Section 3.11 - Land Use is in compliance with the final regulations. <br />13.
