•~ ~ i • <br />General Operation Information <br />Deficiencies: <br />The information given for items 3 and 4 of the application form is no Ienger <br />correct. This information should be updated. <br />I. Legal, Financial, and Compliance - Rule 2.03 <br />Deficiencies: <br />I. The applicant should submit the names and addresses of every officer, <br />partner, director, or other similar persons (Z.03.4(2)(a)J, names and addresses <br />of any principal shareholder (2.03.4(2)(b)), and the names under which the <br />applicant, partner, or principal shareholder operated a coal mining operation <br />in the United States in the last five years (2.03.4(2)(c)). <br />2. If any owner, holder, purchaser, or operator identified under 2.03.4(1) is a <br />business entity other than a single proprietor, the applicant shall submit the <br />names and addresses of their respective orincipals, officers, and resident agents <br />(2.03.s(3)). <br />3. The applicant should submit a statement of the permit or application number <br />and identify the regulatory authority for any current or previous surface coal <br />mining permits in the United States held by the applicant or any person .identified <br />puz'suant to 2.03.4(2)(c) since 1970 (2.03.4(4)). <br />4. The applicant should submit a statement of all lands, interest in lands, <br />options, or pending bids on interests held or made by the applicant for lands <br />which are contiguous to the permit area (2.03.4(7)). <br />5. The applicant should submit additional information on NOV's BO-94, and 81-42. <br />Information that is lacking includes the name of the issuing regulatory authority, <br />status of the violation notice, and final resolution (2.03.5(3)%. <br />6. The applicant should submit proof that the new operator has legal right to <br />enter and mine on Iuppa and Cimino property (2.03.6(1)). <br />7. The applicant should submit a written waiver from the owners of occupied <br />dwellings iocated within 300 feet from an area where any surface mining activities <br />will take place. This waiver shall convey consent to surface mining activities <br />being conducted within 300 feet of their dwellinys (2.03.7(3)). <br />8. Proof of correct newspaper publication should be submitted (2.03.12). <br />II. Land Use - Rules 2.09.3, 2.05.5, and 9.16 <br />Defi ci errci es <br />1. The applicant should submit a range management plan detailing .how the <br />postmining land use is to fe achieved anc? identify any support activities which <br />will be necessary to achieve the postmining 1a nr7 use, such as yra zi ny res tri cCi ons, <br />irrigation practices, or others.
