Cultural and Historic Resources - Rules 2.04.9, and 2.05.6(9) <br />Findings: <br />According to information provided on Wage 2I of the oermit application and <br />from the State Y.istoric Preservation Officer no cultural and historic resources <br />that are on or determined eligible for the IJational Register of Historic <br />Places have been identified within the proposed permit area. <br />Pursuant to Rule 2.07.6(2)(e), the Division finds that this mining operation <br />will not adversely affect any publicly owned park or place listed or. the <br />IJational Register of Historic Places. <br />The operation is in compliance with t!+e requirements of this section. <br />IV. Geology - Rules 2.04.5 and 2.04.6 <br />Deficiencies: <br />1. The applicant must submit the results of a sulfur form analysis of the coal <br />to be mined (?.04.6(2)(a)(iii)(C). <br />2. The applicant should submit the results from a chemical mineral analysis of <br />the roof, floor, and interburden materials for both coal seams and any other <br />materials that are to be stored or disposed of on the surface (2.04.6(2)(a)(iv) <br />(D). See Appendi:r A fora complete list of parameters to be included in the <br />analysis. <br />V. Hydrologic Balance: Surface (dater - Rules 2.04.5, 2.04.7, 2.05.3(4), 2.05.6(3) <br />a nr7 4.n5 <br />Deficiencies: <br />1. The regional hydrology discussion should be expanded to include surface <br />water quality and quantity information for Raton Creek. Flow data on Raton <br />Creek is needed to determine the significance of the Starkville Gulch to the <br />hydrologic regime (dilution effects) and to assess the watm~ availability <br />characteristics of the stream. !dater yualiLy in forma tin is needed to serve <br />as an indicator of downstream impacts from the Starkville drainage and associated <br />gz'ound water systems affected by the mine. <br />7. The application mentions that many old spoils are loeatr_d in and adjacent to <br />Starkville Gulch. A discussion and appropriate map should be provided which <br />identifies the location, extent, and age of the spoil material. A qualitative <br />prediction of how much this material impacts the hydrologic balance would be <br />useful since it would lend perspective to any potential impacts from the Animas <br />operation. Surface and yrounrl watr_r impacts of the old spoils should be ar7drussed. <br />
