Bor. 247
Trinidad, Colorado 31062
Dear Mr. Barton:
The Division has reviewed the most recent permit application for the Helen mine
with the intention of writing the required findinys of compliance (encompassing
all aspects of the operation) which must be made prior to permit issuance. The
enclosed ma terials~represent the results of this revieca. The Division was able
to make findings of compliance in several areas.
For most topics there are still deficiencies in the application which require
the submittal of additional information, and must be resolved in order for
the Division to write findings. I have indicated those findings the Division
was able to maY.e, as well as those deficiencies which need to be resolved.
The timely approval of your mine plan and issuance of the permit will be directly
related to the adequacy and er,pediency of your reponses to the deficiencies. P.11
responses must be submitted to the Division in a form that can easily be in-
corporated into the existing oermit application.
It is also important that all changes to the mine plan that have been submitted
for the abatement action be incorporated into the permit application. This
includes changes to the permit boundary, sediment pond, permanent diversion and
coal processing plant. A11 applicable maps in the permit application must be
amended to depict these features in their final, approved configurations.
If you have any further questions please contact Fred Banta or me at the Division.
It is advisable that you schedule a meeting with the Division staff to discuss
the finer points of resolution of the deficiencies identified.
Sincerely,
t)~1~c'w' r
~;C1
Brian E.
