Bor. 247 <br />Trinidad, Colorado 31062 <br />Dear Mr. Barton: <br />The Division has reviewed the most recent permit application for the Helen mine <br />with the intention of writing the required findinys of compliance (encompassing <br />all aspects of the operation) which must be made prior to permit issuance. The <br />enclosed ma terials~represent the results of this revieca. The Division was able <br />to make findings of compliance in several areas. <br />For most topics there are still deficiencies in the application which require <br />the submittal of additional information, and must be resolved in order for <br />the Division to write findings. I have indicated those findings the Division <br />was able to maY.e, as well as those deficiencies which need to be resolved. <br />The timely approval of your mine plan and issuance of the permit will be directly <br />related to the adequacy and er,pediency of your reponses to the deficiencies. P.11 <br />responses must be submitted to the Division in a form that can easily be in- <br />corporated into the existing oermit application. <br />It is also important that all changes to the mine plan that have been submitted <br />for the abatement action be incorporated into the permit application. This <br />includes changes to the permit boundary, sediment pond, permanent diversion and <br />coal processing plant. A11 applicable maps in the permit application must be <br />amended to depict these features in their final, approved configurations. <br />If you have any further questions please contact Fred Banta or me at the Division. <br />It is advisable that you schedule a meeting with the Division staff to discuss <br />the finer points of resolution of the deficiencies identified. <br />Sincerely, <br />t)~1~c'w' r <br />~;C1 <br />Brian E.
