-8- <br />21. All springs in the 5-year permit area and adjacent area shall be <br />monitored for discharge and water quality on a quarterly basis. Also, <br />all springs on the northern half of the Dry Fork of Itinnesota Creek basin <br />shall be monitored monthly for rate of discharge, pH, temperature, and <br />conductivity when weather conditions permit. <br />22. All water quality analyses shall include [hose parameters in Table 4.9.1 <br />(of the mine plan) plus arsenic. -' <br />817.41 Hydrologic Balance: Surface Water <br />23. ARCO Coal Company is required to submit a sediment control plan for the <br />load site to the regulatory authority prior to initiation of construction <br />of the loadout facilities. <br />24. Should the applicant encounter more ground water than anticipated, the <br />applicant shall provide to the regulatory authority an analysis of <br />anticipated water quality and quantity, and an assessment of the effects <br />on the receiving stream prior to any discharge. <br />25. The applicant shall notify the regulatory authority prior to commencing <br />ditch construction in any potential landslide area. A qualified, <br />registered professional engineer shall certify by letter that the <br />dewatering system is operational and that constn~ction will not increase <br />the potential for landslides in the identified hazard area(s). <br />817.54 tJater Rights and Replacement <br />26. The applicant shall submit to the regulatory authority copies of the <br />reports, exhibits, and all subsequent amendments submitted to the <br />Gunnison County Planning Commission, titled Protection of 'finnesota Creel: <br />Water Supply. This material shall be submitted in a form which can be <br />inserted into the permit application and referenced in the text section <br />2.8.5.1, as required under CMLRD Rule 2.04.7(3), Alternative Water Supply <br />Information. <br />27. The monitoring plan proposed by ARCO Coal Company to Gunnison County <br />Planning Commission should be included within the application Section <br />4.9, Surface and Ground Water Monitoring. All data and reports submitted <br />to the State Engineers Office and ditch companies shall be copied to the <br />regulatory authority as inclusions within the quarterly repoct required <br />under Section 4.05.13(2) of the CMLRD rules and regulations. <br />817.57 Stream Buffer Zones <br />28. The applicant must secure authorization from the regulatory authority to <br />locate surface facilities within the stream buffer zone of the North <br />Fork. <br />
