These plans <br />shall be submitted to [he regulatory authority prior to issuing the next <br />5-year permit. <br />817.21 Topsoil Protection <br />8. ARCO will submit, to the regulatory authority, prior to any topsoil <br />removal, information from a soil monitoring program (conducted prior to <br />topsoil stripping) if the monitoring program demonstrates that less than <br />18 inches of suitable topsoil is available for revegetation. Information <br />from the monitoring plan will be used by the applicant and the regulatory <br />authority to establish an approved soil handling plan. <br />9. Until such time that ARCO can demonstrate to the regulatory authority the <br />following, 1) non-combustibility of the waste rock material, 2) stability <br />of waste rock stockpile, and 3) non-toxicity of waste rock material to <br />surface and ground water and vegetation, a 4-foot cover of non-toxic <br />material will be required for the waste rock stockpile. <br />817.41 Hydrologic Balance: General Requirements <br />10. ARCO Coal Company or any succeeding operator of the Mt. Gunnison No. 1 <br />t11ne must submit to the CtSLRD an annual hydrologic report. This report <br />shall include an analysis of all hydrologic data gathered durinv, the <br />year, an assessment of the impacts of mining during the year, and an <br />estimate of the projected impacts of mining in the following year. This <br />report shall assess the impacts of mining on the quality and quantity of <br />water in surface streams, springs, ground water aquifers, mine inflow and <br />mine discharges. <br />11. The applicant shall conduct new pumping tests on wells completed in the <br />Barren Member and F seam. The applicant shall use the data from these <br />tests to compute new estimates of the cone of influence produced by <br />mining, the quantity of mine water which may be depleted by mining. A <br />report containing the data and the results from the above tests and <br />calculations shall be submitted [o the regulatory authority as inclusions <br />to the permit application within 6 months of the permit issuing. <br />12. The applicant shall install the two proposed monitoring wells below the <br />initial waste rock pile prior to its construction. The applicant shall <br />submit to the regulatory authority well completion reports and <br />ground-water level quality data prior to placing waste rock in the pile. <br />13. The applicant shall submit to the regulatory authority an annual report <br />of inflows, discharges, and consumption of water within the mine. This <br />report is to include a mine workings map showing the location and <br />quantity of inflows; a table keyed to tine mine map which shall contain <br />the source. (i.e., fault, fractures, etc.), quantity, duration, and <br />quality (i.e., pH, electro-conductivity and temperature) of all inflows; <br />a table containing records of water discharged from the mine, consumed in <br />the mine, and imported for use within the mine; a discussion of the water <br />balance within the mine; and finally a projection of hydrologic impacts <br />of mining in the upcoming year. <br />
