/ - -5- <br />l SPECIAL STIPULATIONS <br />The following is a compilation of stipulations which the Office of Surface <br />Mining Reclamation and Enforcement (OSM) and the Colorado ttined Land Reclama- <br />tion Division (CMLRD) require of the applicant. For the purposes of these <br />stipulations "regulatory authority" means both CtiLRD and OSti, unless formally <br />changed by cooperative agreement. Due dates for stipulation requirements <br />shall be those set by CtiLRD, unless .otherwise specified (see stipulations 6, <br />7, 29, and 47). <br />770.4 Permits <br />1. Neither ARCO Coal Company nor any succeeding operator of the Mt. Gunnison <br />project's coal leases and reserves will be permitted to mine coal outside <br />of the first 5-year permit boundary, until Ct4LRD has received a copy of <br />an adjudicated plan of augmentation. <br />2. ARCO Coal must include within the permit application all ARCO responses <br />contained in the two volumes titled "Responses to State M.L.R. Comments" <br />and "Completeness Review Responses". This must be completed within six <br />months after final permit approval by the regulatory authority. <br />785.19 Alluvial Valley Floors <br />3. Within 6 months of the permit issuance, the applicant shall demonstrate <br />that the mining operations' fresh water usage would not materially damage <br />the quantity and quality of those waters supplying alluvial valley <br />floors. The applicant shall also submit a plan for [lie monitoring of the <br />agricultural usage and productivity of the alluvial valley floors. The <br />monitoring plan shall go into effect during the 1982 growing season. <br />4. In its annual hydrology assessment, the applicant shall include water ' <br />quantity and quality data from the USGS Somerset monitoring station. <br />Should the USCS discontinue monitoring at this location, the operator <br />shall submit its own quality and quantity monitoring program for the <br />North Fork of the Gunnison to the regulatory authority. <br />5. The mine plan discussion of irrigation of agricultural lands in ttinnesota <br />Creek and the North Fork of the Gunnison should be expanded to include <br />more information on the importance of subirrigation in these areas. <br />Additional information regarding the level of flood irrigation of the <br />identified alluvial valley floors should be provided. The applicant <br />should prepare an investigation of the essential hydrologic functions of <br />these areas. <br />817.15 Casing and Sealing Underground <br />6. ARCO Coal must submit to the regulatory authority plans and specifica- <br />tions for the sealing of portals and capping of wells to demonstrate that <br />the proposed sealing methods will not interfere with or interrupt the <br />permanent operation of the drainage system. -`, <br />7. ARCO must describe in detail the method of capping (or filling) bore <br />holes from the surface in order to prevent hazards to the hydrologic <br />balance. This information must be submitted to the regulatory author- <br />ity. The applicant must present plans showing how mine openings will be <br />
