<br /> <br />-l o- <br />The operation is in compliance with the requirements of this section. <br />XV. Operations Description - Rules 2.05.2, 2.05.3(3), 2.05.3(2) and 4.01 <br />This section does not apply since the proposed decision is to issue a <br />reclamation only permit. <br />XVI. Backfillinq and Grading - Rules 2.05.3(4). 2.05.3(9). 2.05.4(21(a). <br />The backfilling and grading portion of the application is found in <br />Section 2.05. The operator will remove all coal from the site and cover the <br />pad with gravel. The operator states that 2 inches of gravel will be placed <br />over the area. The Division feels a greater depth is needed. Therefore the <br />following stipulation is required. <br />Stipulation No. 3 <br />UPON FINAL GRADING OF THE SITE AND REMOVAL OF COAL THE ENTIRE DISTURBED AREA <br />WILL BE COVERED WITH GRAVEL TO A DEPTH OF 3-5 INCHES. <br />The final grading will create a flat pad that is suitable to an industrial <br />post-mining land use. <br />With the acceptance of the above stipulation the operation is in compliance. <br />XVII. Coal Processing Waste and Non Coal Processing Waste - Rules 2.05.3(8) <br />As stated earlier this is a partial approval for reclamation only. Given <br />this, no coal waste will be generated from the site. All non-coal waste will <br />be disposed of in an approved land fill site as stated in the application. <br />The operation is in compliance with the requirements of this section. <br />XVIII. Mine Facilities <br />Ru es <br />1 Handling Structures and Support Facilities - <br />All facilities will be removed from the site during reclamation. Final <br />disposition of all structures is discussed in Section 2.05 of the permit <br />application. <br />The operation is in compliance with the requirements of this section. <br />XIX. Roads - Rules 2.05.3(3) and 4.03 <br />The haul/access road connects the loadout with U.S. Highway 40. Pursuant to <br />landowner request this road will remain after reclamation. All access, light <br />use roads within the permit area will be removed during reclamation. <br />The operation is in compliance with the requirements of this section. <br />
