Operations Description - Rules 2.05.2, 2.05.3(3), 2.05.3(2) and 4.01 This section does not apply since the proposed decision is to issue a reclamation only permit. XVI. Backfillinq and Grading - Rules 2.05.3(4). 2.05.3(9). 2.05.4(21(a). The backfilling and grading portion of the application is found in Section 2.05. The operator will remove all coal from the site and cover the pad with gravel. The operator states that 2 inches of gravel will be placed over the area. The Division feels a greater depth is needed. Therefore the following stipulation is required. Stipulation No. 3 UPON FINAL GRADING OF THE SITE AND REMOVAL OF COAL THE ENTIRE DISTURBED AREA WILL BE COVERED WITH GRAVEL TO A DEPTH OF 3-5 INCHES. The final grading will create a flat pad that is suitable to an industrial post-mining land use. With the acceptance of the above stipulation the operation is in compliance. XVII. Coal Processing Waste and Non Coal Processing Waste - Rules 2.05.3(8) As stated earlier this is a partial approval for reclamation only. Given this, no coal waste will be generated from the site. All non-coal waste will be disposed of in an approved land fill site as stated in the application. The operation is in compliance with the requirements of this section. XVIII. Mine Facilities Ru es 1 Handling Structures and Support Facilities - All facilities will be removed from the site during reclamation. Final disposition of all structures is discussed in Section 2.05 of the permit application. The operation is in compliance with the requirements of this section. XIX. Roads - Rules 2.05.3(3) and 4.03 The haul/access road connects the loadout with U.S. Highway 40. Pursuant to landowner request this road will remain after reclamation. All access, light use roads within the permit area will be removed during reclamation. The operation is in compliance with the requirements of this section.
