-g- <br />The only area to be revegetated is the containment berm. This berm will be <br />composed of onsite materials that should support adequate plant growth to <br />control erosion. <br />The operation is in compliance with the requirements of this section. <br />XII. Vegetation - Rules 2.04.10, 2.05.4(2)(e) and 4.15 <br />As stated earlier the area is to be returned to an industrial post-mining <br />landuse. As such there is very little area that will need to be revegetated. <br />The applicant did not give a seedmix or propose success standards for <br />revegetation, therefore the following stipulations are required. <br />Stipulation No. 1 <br />THE OPERATOR WILL RESEED THE CONTAINMENT BERM WITH THE FOLLOWING SEED MIX: <br />1. INTERMEDIATE WHEATGRASS 5LBS PLS/AC. <br />2. CRESTED WHEATGRASS 2LBS PLS/AC. <br />3. REGAR MEADOW BROME 2LBS PLS/AC. <br />4. WESTERN WHEATGRASS 3LBS PLS/AC. <br />5. CICER MILKVETCH .5LBS PLS/AC. <br />Stipulation No. 2 <br />THE COVER STANDARD FOR THE REVEGETATED AREA SHALL BE A GROUND COVER OF LIVING <br />PLANTS ADEQUATE TO CONTROL EROSION AS REQUIRED BY RULE 4.15.10. <br />Given that the area has been disturbed since the 1920's and no new disturbance <br />is proposed there is no threat to any plants that may be listed on the <br />threatened or endangered plant species list. <br />With the acceptance of the above stipulations the operator is in compliance <br />with the requirements of this section. <br />XIII. Fish and Wildlife - Rules 2.04.11, 2.05.6(2), and 4.18 <br />Fish and wildlife resource information is found in Sections 2.04 and 2.05 of <br />the permit application. Due to the history of disturbance and the relative <br />small area of disturbance, no significant impacts are anticipated. In <br />addition, this proposed decision will authorize only reclamation therefore, no <br />new impacts to fish and wildlife are expected. <br />Pursuant to Rule 2.07.6(2)(n), and on the basis of available information, the <br />Division finds that the proposed activities will not effect the continued <br />existence of endangered or threatened species or result in the destruction or <br />adverse modification of their critical habitats. <br />The operator is in compliance with the requirements of this section. <br />XIV. Prime Farnland - Rules 2.04.12, 2.06.6 and 4.25 <br />Pursuant to Rule 2.07.6(2)(k), the Division has made a negative prime farmland <br />deternination. The determination was made based upon information contained in <br />a letter from the U. S. Soil Conservation Service. This letter is found in <br />Exhibit 6 of the permit application. <br />
