Water Rights and Replacement - Rules 2.04.7(3), 2.05.6(3)(ii),
g an
The reclamation operation will not require the use of any water. Given this
no water rights would be adversely affected.
The operation is in compliance with the requirements of this section.
IX. Probable Hydrologic Consequences of Mining and Cumulative Hydrologic
- rcuies c.uo.ois! a
The probable hydrologic consequences of reclamation of the Mt. Harris Loadout
are quite limited due to the small size of the disturbance, (less than 10
acres). If anything, reclaiming the site will reduce any impacts along the
Yampa River. All coal will be removed from the site, and all runoff will be
contained within a berm to be constructed around the disturbed area. Removal
of coal will also reduce any possible impacts to the alluvial aquifer.
An assessment of the probable hydrologic consequences of the proposed
operation and an assessment of the probable cumulative impact of all
anticipated mining on the Upper Yampa River (above Twenty-mile park) has been
made. The reader is referred to the Division's findings of compliance for the
Meadows No. 1 Mine (Permit No. C-81-029) fora Cumulative Hydrologic Impact
Study for the upper Yampa River Drainage.
Pursuant to Rule 2.07.6(2)(c), the Division finds that reclamation of the
Mt. Harris loadout has been designed to prevent material damage to the
hydrologic balance outside the permit area.
X. Climatological Information and Air Resources -Rules 2.04.8
2. and
The required climatological information is presented in Section 2.04 of the
permit application. Dust control will be accomplished by placing a 3-5 inch
layer of gravel over the existing pad.
The operation is in compliance with the requirements of this section.
XI. Topsoil -Rules 2.04.9, 2.05.3(5), 2.05.4(2)(d), and 4.06
Topsoil resources in the permit area were destroyed in the 19205 with the
construction of the original town of Mt. Harris. The operation will reclaim
the site to an industrial land use. No topsoil was ever salvaged therefore
there is none to be redistributed.
