Mr. Dan Mathews, MLRD <br />Page 2 <br />The second site is a dwelling owned and occupied by Mr. Robert Kuretich. <br />The dwelling is located approximately 275 feet from the north-east corner <br />of the Permit area. <br />Attempts have been made on numerous occasions to keep Mr. Kuretich informed <br />of our plans and activities at the Terror Creek site and to solicit his <br />cooperation; however, such attempts at cooperation have been futile to date. <br />Mr. Kuretich was approached on June 24, 1983 concerning the necessity <br />of his signing off on the load-out facility as per Rule 2.07.06. On June <br />26, 1983 Kuretich was presented a letter for his signature in compliance <br />with the Rule, but he declined to sign and requested more time to consider <br />the matter. Almost daily contact with Kuretich has not resulted in receipt <br />of the letter, but has instead met with continued procastination. <br />It should be brought to the attention of the Division that Kuretich is <br />a long time employee of, and manager for, Coors Energy Corporation. <br />As the Division is aware, management of Coors Energy have made certain <br />statements to MLR staff members to the effect that Terror Creek Company <br />would never be able to operate the load-out facility. Similar statements <br />to the same premise have been made by Coors Energy to the Colorado Department <br />of Highways, Delta County Board of Commissioners and others. No implication <br />or accusation is being levied at this time towards Mr. Kuretich for the <br />withholding of his consent for other than personal reasons; however, <br />the Division should be aware of the entire situation. <br />It is expected that Kuretich, after much deliberation and delay, will <br />sign the waiver document. However, should he absolutely decline to do <br />so, Terror Creek Company will propose an alternate plan. This alternate <br />plan will entail the relocation of the Permit boundary to 300.1 feet <br />equidistant from the occupied dwelling. Such relocation of the boundary <br />will have no effect on disturbed acres nor on the operation of the <br />facility; and the Permit application will in no way be changed except <br />for a slight reduction in acreage to be permitted. The Division will be <br />notified immediately upon execution or non-execution of the waiver document. <br />If Kuretich declines to sign the waiver document, an application for revision <br />of the Permit area will immediately be filed. <br />
