Dep!. of ~!a7ural Resource <br />Dear Mr. Mathews: <br />I have received your letter of June 22, 1983 representing the Division's <br />final adequacy letter for the Terror Creek Load-out and notice of a proposed <br />decision to be published June 30, 1983. <br />The majority of comments brought forth in the final adequacy letter have <br />been referred to ACZ, Inc. for response (my discussions with ACZ indicate a <br />response letter had been sent to your office); however, certain items have been <br />retained by Terror Creek for response. These items are: Rule 2.07.6 Surface <br />Mining Operations Within 300 Feet of an Occupied Dwelling; and Rule 2.03.9 <br />Personal Injury and Property Damage Insurance. <br />Rule 2.07.6(2)(A)(V) Operations Within 300 Feet Of Occupied Dwellings <br />-------------------- <br />There are two occupied dwellings located adjacent to the Terror Creek <br />permit area and possibly subject to Rule 2.07.6(2)(A)(V). <br />The first site is a dwelling owned and occupied by Mr. Adam Bronish. The <br />dwelling is at a south-central location to the Permit area, immediately <br />south of the Denver & Rio Grande Railroad right-of-way. <br />Mr. Bronish has been most cooperative in our efforts at installation and <br />operation of the Terror Creek Load-out. Such cooperation is demonstrated <br />by the execution of a letter by Mr. Bronish signifying his consent for the <br />Terror Creek Load-out activities within 300 feet of his residence. A <br />copy of this letter is enclosed. <br />
