5 • • <br />PRELIMINARY ADEQUACY REVIEW <br />Sheridan Enterprises-Munger Canyon <br />2.03.6 Riqht of Entru and Operation <br />Exhibit C-VII in Appendix C of the application inaccurately refers to the <br />access road as being in T8S rather than T7S (indicated in Figure Z.l-2). <br />Please amend this location if incorrect. <br />2.03.10 Identification of Other Licenses and Permits <br />The applicant needs to supply the Division with documentation indicating <br />possession of a current NPDES permit. Also, are there any speical use <br />permits issued by local authorities (particularly for the loadout)? <br />Please provide identification numbers and provisions of these permits and/ <br />or licenses. <br />2.04.3 General Requirements: Site Description and Land Use Information <br />It is recognized that the applicant may have supplied information required <br />in 2.09.3(2) in various sections of the application other than Land Use. <br />Colorado regulations however, require, "a statement of the condition, <br />capability, and productivity of the land within...those areas affected or <br />to be affected by surface operations..." including "A narrative of land <br />capability and productivity which analyzes the Iand use description" (See <br />Rule 2.04.3(2][b]). A narrative must be included in the Iand use section <br />to satisfy this regulation. This information will greatly aid the Division <br />in assessing the proposed reclamation plan with respect to re-establishment <br />of pre-mining conditions. <br />2.04.9 Cultural and Historic Resource Information <br />1. An explicit statement that alI areas of potential surface disturbance <br />have been 100ffi surveyed is needed, with exact areas of survey shown on <br />maps, and concise legal descriptions and acreage of inventory. <br />2. Amore detailed explanation of sample selecting procedures is needed. <br />Also an evaluation of the chance of finding further rock art or rock shelter <br />sites in the potential subsidence areas needs to be addressed. A general <br />overview of the historic period of the area is needed; including fur trade, <br />early settlement, development of mining, agriculture, railroads, etc. <br />3. The prehistoric background is adequately covered in the submission <br />however the later historic periods are not addressed. An understanding <br />of the area's historic development (fur trade, early settlement, develop- <br />ment of agriculture, coming of the railway and mineral exploration including <br />coal) is integral to understanding the cultural resources of the mine plan. <br />4. Disturbed or potentially disturbed areas need to be clearly documented <br />with maps and Legal descriptions, and the relationship of the cultural <br />resources to these areas clearly defined. <br />
