<br />The applicant is also committed to prevent and not use fire <br />during reclamation or wildlife improvement activities, and <br />non-persistent herbicides shall be used to control weeds (page <br />20, Appendix G, Vol. II of the permit application). These <br />chemicals will be limited to those having the approval of the <br />Environmental Protection Agency and other state agencies. In <br />order that the regulatory agencies can monitor the use of these <br />chemicals, in accordance with section 4.18(4)(9) of the Colorado <br />Permanent Regulatory Program, it is necessary that the applicant <br />obtain approval for herbicides to be used at the mine site. <br />Therefore, the following stipulation is proposed. <br />At least 60 days prior to using a herbicide in the <br />permit area, the applicant rill request approval of <br />that herbicide and it's intended application from the <br />regulatory authority. <br />-99- <br />
