The DMG notes on Map 2 there is a portion of coal owned by <br />Deloris wood (labeled as 04) and James and Carolyn Norris <br />(labeled as 05) located within the permit area for which BRL <br />has not provided the right to enter or lease information. The <br />DMG is correct, BRL does not have right of entry for these <br />lands because BRL does not intend to mine the coal on these <br />lands. BRL's mine plan does not indicate this coal will be <br />mined. It should be noted that the land owned by James and <br />Carolyn Norris is not within BRL's proposed permit boundary. <br />6. An insurance certificate will be transmitted to the DMG as <br />soon as possible. <br />7. Air Emission Permits and Discharge Permits will be transmitted <br />to the DMG as soon as they are received. <br />8. Map No. 26, Previously Disturbed Areas was revised to <br />incorporate the requested table which lists 1) proposed <br />disturbed area boundary; 2) proposed disturbed area; 3) <br />redisturbed area; and 4) previously disturbed area within the <br />proposed disturbed area boundary. Enclosed is revised Map No. <br />26. <br />9. Enclosed is revised page 2.04-10 which provides a summarized <br />general description of Hydrology and Geology. <br />10. The DMG notes that a fault discussed on page 2.04-14 is not <br />shown on Maps O5, 06, 07 or 08. The indicated fault is shown <br />on Map 14, Mine Plan Map and Map 27 Subsidence. The fault <br />location was added to Map 7, Geology. BRL has no comment <br />regarding the DMG's discussion of the faulting at the Bowie <br />No. 1 Mine. Revised Map 7, Geology is enclosed. <br />11. No comment at this time regarding the acid generating <br />potential of the coal. <br />12. Enclosed are monitoring hole completion drawings to be <br />incorporated into Volume III, Exhibit 3. <br />13. Page 2.04-22 states that the groundwater investigation was <br />performed over the area bounded by Terror Creek, Hubbard Creek <br />and the North Fork of the Gunnsion. A statement was added at <br />the end of this section which states the actual monitoring <br />locations are shown on Map 9, Monitoring Location Map. <br />Enclosed is revised page 2.04-22. <br />It is true there are no groundwater monitoring wells outside <br />of the permit boundary. However, there are three ponds and <br />six springs, shown on Map 9, that are monitored which are <br />outside of the proposed permit boundary. <br />
