Dear Mr. Berry:
The Division's letter dated May 31, 1996 transmitted its
preliminary adequacy review for the referenced permit application.
Following are BRL's responses to the DMG's concerns:
1. The ownership and control information presented in the permit
following page 2.03-23 has been updated. Enclosed is a new
ownership and control section. The pages in this new section
have been numbered sequentially from 2.03-24 - 2.03-66.
Enclosed are the new pages.
2. The DMG states it is not clear in the application what
Exhibits B, D, or G represent. The referenced exhibits in the
text listed mines owned or controlled by Larry Addington. The
reference to the exhibits was changed in the text to refer the
reader to the new ownership and control section beginning on
page 2.03-24. Enclosed are revised pages 2.03-4, 6, 7, 8 & 9.
3. Section 2.03.6 was revised to reference the location of the
complete and detailed legal description of the proposed permit
boundary which is presented in section 2.03.12 (page 2.03-22).
The legal description presented on page 2.03-22 was revised to
indicate certain portions of the proposed permit area are
located North of old State Highway 133. Enclosed are revised
pages 2.03-16 and 2.03-22.
4. The Special Warranty Deed, Assignment, and Bill of Sale are
presented in Volume III, Exhibit 1. These are the documents
which BRL bases its right to enter and conduct coal mining
operations. As requested, enclosed are copies of the
signature pages of the Deed with legible corporate and notary
seals.
