Mr. Dave Canning <br />Page Two <br />~Ap'ril 15, 1982 <br />Valid existing rights can be demonstrated by providing documentation of <br />the legal rights to enter and copies of state and/or federal permits <br />to mine coal issued prior to August 3, 1977. The right to enter informa- <br />tion has been presented but documentation by way of copies of the USGS <br />211 permit, the Colorado State Bureau of Mines license, a Colorado Mined <br />Land Reclamation permit, or the annual reports of coal production to <br />the USGS or the Bureau of Mines must be included in the permit <br />application. <br />2.04.3 Site Description and Land Use Information <br />In order to grant a variance from approximate original contour <br />as requested in the backfilling and grading sections of the permit <br />application,the post mining land use for a portion of the permit area <br />should be changed to public land use in accordance with 2.06.5(2), <br />because the county public righ[-of-way exists immediately below the portal <br />bench. <br />2.04.4 Cultural and Historic Resources Information <br />Each copy of the permit application should contain a copy of the attached <br />letter from the Colorado Historical Society which states that within <br />the permit area no sites have been identified which are in or eligible <br />for the National Register for Historic Places. <br />2.04.7 Ground lJater Hydrology <br />a. Discrepancies exist in the permit application as to the occurence <br />of ground water within the permit and adjacent areas. <br />On pages 64 and 65 of the permit application, the applicant <br />speaks of inflows encountered during mining below the 7350 feet <br />structural contour, However, on page 26, the applicant states: <br />"No ground water was encountered in ANY of the drill holes within <br />the permit area." Fourteen drill holes were drilled through <br />the coals to depths equal to or greater than 7350 feet SMSL. <br />Sun land Coal Corporation should prepare a map showing those <br />drill holes which encountered water and at what depths water was <br />encountered. <br />2. In order to describe the present impacts of mining on ground water, <br />Sun land Coal Corporation should submit a mine inflow study. This <br />study should consist of a mine working map (eg an updated <br />Exhibit C) with 1) the location of all mine inflows; and 2) <br />the source of the inflow (i,e. flow from caved workings, faults, <br />fractures, cleating in the coal, roof fall areas, weeping roof, <br />floor seeps, etc.).
