Shelton <br />Director <br />April 15, 1982 <br />Mr. Dave Canning <br />Sunland Mining Corporation <br />Post Office Box 55 <br />Oak Creek, Colorado 80467 <br />RE: Apex No. 2 Mine Permit Application - 2nd Adequacy Review <br />File No. C-Oll-81 <br />Dear Mr. Canning: <br />The Mined Land Reclamation Division has completed a technical review of the <br />Apex No. 2 permit application, Several deficiencies and concerns were identified <br />during the review which must be resolved before the Division can complete the <br />required written findings and issue a decision on the permit application. <br />The following comments are in addition to those raised in the Division's, <br />April 20, 1981 adequacy review of the application. tdhenever possible, the responses <br />should be submitted in the form of revised pages to the permit application. Your <br />prompt reply to these concerns should enable the Division to issue a decision in <br />an expeditious fashion. <br />It has been brought to my attention that the footnote tables are considered <br />inappropriate for inclusion in the permit application. These tables must be <br />removed from the permit application. <br />2.03 Legal and Financial Compliance <br />Information provided on the map prepared by Dismuke and Dismuke Engineering <br />shows a trailer within 300 feet of the surface facilities. Since this <br />trailer is considered an occupied dwelling, the application must contain <br />a signed waiver by the owner of the dwelling in accordance with Rule <br />2.03.7(3). <br />In order to permit the surface facility areas within 100 feet of a county <br />road, the applicant must demonstrate valid rights existing as of August <br />3, 1977 or go through the local approval process as delineated in Rule <br />2.07.6(2)(d)(iv). <br />
