A least one year prior to initiation, the applicant shall submit a <br />detailed management plan to the Division for approval. <br />2.05.6 Mitigation of the Impacts of Mining Operations <br />The applicant should provide copies of the application for air quality <br />permits or a copy of the permit to which the applicant wishes to succeed <br />(provided that Chere are no anticipated changey). <br />2.06.9 Auger Mining <br />1. In order for the Division to make a determination that the coal reserves <br />have been depleted and waive the requirements of 4.23.2 (1 ),the applicant <br />needs to provide additional information on the abandoned underground workings. <br />Maps IV-2 and IV-2A are not of a nature such that the Division can determine <br />I remaining reserves and proximity to the proposed operation. The applicant <br />should provide a discussion and map which locates abandoned underground <br />workings relative to the applicant's proposed mine plan. <br />2. The applicant must commit to the plugging of auger holes in accordance <br />with 4.23.2)4)(a) unless the applicant can demonstrate to the Division that <br />drainage from the auger holes will not pose a threat of pollution to surface <br />water and impoundment of the water by plugging the hole may Great a <br />hazard to the environment or public health or safety. <br />2.06.10 Coal Processing Plants and Support Facilities NoC Located Within <br />the Permit Area <br />This section of the regulatiuns does not apply to the applicant's loadout <br />since that facility is covered under this permit application. The applicant <br />has made an erroneous contention that the performance standards of rule 4.28 <br />do not apply.
