Binns
Subject: Lorencito Mine, I , 1997 Adequacy Response Roy Romer
Governor
Date: July 25, 1997 lames 5. Lochhead
Executive Director
I have com leted m review of Lorencito Coal Com an s res onses to the Division's Michael B. Long
P Y P Y P Division Director
adequacy letter dated May 27, 1997. Outstanding items of concern that I reviewed were in
relation to adequacy concerns No. 57,59,190, 191, 192, and 195. Responses regarding
reclamation liability estimates are still being considered.
Revised page No. that were reviewed include Pages 2.04-44, 2.04-45, 2.04-49, 2.04-50,
2.04-51, Map 2.04.10- I , 2.05-33, 2.05-33a, 2.05-33b, 2.05-34, 2.05-35, 2.05-59, 2.05-59a,
2.05-61, 2.05-66, 2.05-66a, 2.05-71, 2.05-73, 2.05-73a, 2.05-80, Map 2.05.3-3e, and
Exhibit 10 pg. 5 & 7.
57) Lorencito Coal Company revised page 2.04-45 to commit to sampling the mountain
• shrub and Pinyon/uniper communities prior to conducting any Mine related
disturbances in these vegetation types. This response is appropriate.
59) Page 2.05-71 was revised to eliminate the last statement on the page as requested.
192) Page 2.05-73 has been revised to describe the methods employed in baseline woody
plant density data collection and how this data will be collected at reclamation success
determination. This response is appropriate.
195) Lorencito Coal Company revised Table 2.05.4-2, Seed Mixture for the Grassland
Community, to incorporate additional warm season grass species. The species
included are appropriately adapted and palatable for the post-mining land use. These
three species are small seeded so the resulting small overall quantities of seed, 0. I -
0.2 pounds seed /acre results in a signifcant increase in the number of PLS/Fiz. The
nature of many of the warm season grass species finds that the seed may remain
dormant in the ground years after seeding. Therefore this apparently high seeding
rate would not be detrimental. Of small note Sporobo/us airoides was misspelled on
page 2.05-66.
Items no. 190 and 191 involve re-establishment of shrubs and determination of Woody Plant
Density (WPD) success. This item was not addresses in Lorencito Coal Company's July I ,
• 1997 submittal. This item remains outstanding. The Division will attach a stipulation to the
permit to resolve the shrub establishment success criteria.
^
<,..
