Language has been put into 2.05-59a. <br />91. LCC would like to take a phased approach to the geotechnical investigation of the fills at the <br />Jeff Canyon surface mine. This would expedite mining in the first two yeazs of the <br />operation, minimize disturbances in the eastern portions of the Jeff Canyon Mine to ensure <br />proof-of-concept and allow LCC and the Division to identify patterns and relationships in <br />the azea which might lead to a more focused and efficient investigations in the future. <br />Phased investigations were previously discussed between Mazk Gray and Jim Pendleton, and <br />LCC was of the understanding that this would be acceptable. The purpose of providing the <br />methodology was to obtain approval from the Division's engineer of the protocol such that <br />the future, stipulated submittal would be applicable to meet the requirements of Rules <br />2.05.3(6)(b) and (c) and 4.09 at Fills 1 through 4. Is there a way to structure the stipulation <br />to allow phased geotechnical investigations? <br />98(c). Page 2.05-37a has been modified to reflect the correct map, 2.03.3-4. <br />102. LCC will request that Picketwire to modify the New Elk permit to permit the disposal of <br />Lorencito refuse at the New Elk disposal site. <br />103. LCC has requested a stipulation to cover the geotechnical issues at the site. <br />110. LCC will provide the applicable air permits as they aze finalized. <br />111. LCC accepts a stipulation to develop a shrub reclamation plan. <br />114. LCC will provide joint approval documents from the CDMG Mine Safety and Training <br />Program and MSHA to perform concurrent surface and underground coal mining activities <br />when it is available, and accepts the stipulation. <br />
