' Seven <br />the feasibility of this land use. 2.05.5(1)(a)(i) <br />2. The applicant needs to address in greater detail the management plan to <br />be implemented as it relates to this land use. Again, this is needed <br />to determine the feasibility of reclaiming this area to irrigated <br />pastureland. Protection measures to be implemented, control of noxious <br />weeds, watering schedules, these are some of the items that need to <br />be discussed in more detail. 2.05.5(1)(iv) <br />Section 2.05.6 Mitigation of the Impacts of Mining Operations <br />1. Since the majority of the disturbed area will be reclaimed to rangeland <br />suitable for wildlife habitat the applicant needs to address Rule 4.18(4)(1) <br />The operator also needs to address Rule 4.18(2)(a) and (b) and 9.18(4)(e) <br />and (f). This information is needed due to the proximity of the opera- <br />tion to Stollstremer Creek and Chimney Rock. Potential riparian vege- <br />tation needs to be protected as well as the nesting site for the <br />Pergine Falcon in the area. 2.05.6(2)(a) <br />2. As stated under Section 2.04.11 of this review, interaction must con- <br />tinue between the Division, Dow and Chimney Rock Coal concerning the <br />Pergrine Falcon issue. Any and all information concerning this issue <br />should be reviewed by the three parties. The Division will contact <br />DOW to ascertain the progress of their studies and their position at <br />this time. Zt should be noted, however, that it is still Chimney <br />Rock Coal's responsibility to demonstrate that this resource will <br />not be adversely affected. 2.05.6(2)(iii)(A)(b) <br />Section 2.06 Requirements for Permits for Special Categories of Mining <br />Section 2.06.4 Steep Slope Mining <br />1. A discussion of how Chimney Rock Coal will meet the performance stand- <br />ards of 9.27.3 is needed. Since the majority of the operation entails <br />removal of coal from steep slopes this information is necessary. <br />Chimeny Rock Coal may elect to obtain a variance under 2.06.5 from <br />restoring ROC. <br />If Chimney Rock does elect to obtain a variance it must demonstrate it <br />meets the requirements of 2.06.5 and the performance standards of <br />Rule 9.27.3, 4.14.1-4.14.6. 2.06.4(3) <br />Section 2.06.8 Surface Coal hfining and Reclamation Operations on Areas, <br />or Adjacent to Areas, Including Alluvial Valley Floors <br />1. Although the applicant supplied the information necessary for the <br />Phase I, Reconnaissance Level Investigation, it is mentioned that <br />the operation may be jrandiaChured. If the applicant elects to pursue <br />this direction it must be demonstrated that coal was produced in <br />commercial quantities during the year prior to August 3, 1977 as <br />stated in Rule 4.24.4. A written finding will still have to be made, <br />however, demonstrating that Chimney Rock Coal's operation will not <br />materially damage the potential Alluvial valley Floor Adjacent to <br />the operation and conform to 114(2)(c) of the Act. 2.06.8(3) <br />
