- Four <br />8. Sample adequacy does not appear to have been met. The Division <br />requires the level of accuracy to be within I0~ of the sample <br />mean, not the 20o proposed. Also, the "t" value used for her- <br />aceous communities should be 1.695 not 1.28. 9.15.8 <br />9. Data is supplied only for Herbaceous cover, vegetation communi- <br />ties need to be sampled for total cover. This information is <br />needed to evaluate the reclamation plan and to determine success <br />criteria. 2.04.10(4) <br />20. Question: How was the "previously developed" vegetation map <br />developed? A discussion of map development is needed. <br />11. A discussion of potential impact to rare and endangered plants is <br />needed in accordance with the requirements of 2.05.6(2)(a)(iii). <br />Section 2.09.11 Fish and Wildlife Information <br />1. Studies being conducted by the Colorado DOW concerning the <br />Peregine Falcon nesting site in the area should be forwarded <br />to the Division upon receipt. The Division will contact the <br />DOW to see how the study is progressing and ascertain the present <br />status of the falcon population. Interaction between the Divi- <br />sion, DOW and Chimney Rack Coal should continue so this issue <br />can be resolved. 2.04.11(4) <br />RULE 2.05 APPLICATION FOR PERA]IT FOR SURFACE OR UNDERGROUND MINING <br />ACTIVITIES. MINIMUPf REQUIREMENTS FOR OPERATION AND RECLA- <br />MATION PLANS. <br />Section 2.05.3 Operation Plan - Permit Area <br />1. Operation Description <br />1. The narrative should give approximate dates as they relate to each <br />phase of the operation described in the text. This information is <br />needed to help correlate the operation timetable with the reclama- <br />tion timetable and to ensure that contemporaneous reclamation will <br />take place. This can be described under 2.03.8(1). 2.05.3(2) <br />2. The application describes a proposed coal preparation facility for <br />the operation. If it is the intention of Chimney Rock Coal to have <br />said facility permitted under this application, then all information <br />necessary to ensure compliance with the Act and Regulations of the <br />Division must be submitted for inclusion in the application. If <br />this information is not submitted then an amendment or technical <br />revision will have to be submitted before any construction of the <br />preparation facility occurs. 2.05.3(3)(a) <br />3. It should be demonstrated that all existing structures (access and <br />haul roads, etc.) meet the performance standards of the Act and <br />Rule 4 pursuant to, 207.6(3)(a)(i)(A). The applicant needs to sub- <br />mit a thorough discussion of the haul road locations, construction <br />and design, drainage, surfacing, maintenance and reclamation as it <br />pertains to compliance with 4.03.1 Haul Road Requirements. <br />2.05.3 (3) (b) (i) (D) <br />
