Stria: <br />As was discussed during the meeting of February 1, 1983 at our office and <br />as Briars Munson and I indicated to you duriny our site visit on February <br />Z, 1983 there are two major tasks which must be accomplished in order for <br />the Division to issue a permit for the Terror Creek Company's coal <br />handling facility near Bo1•+ie. <br />First, the site must be brought into compliance with the performance <br />standartls of the regulations prior to any further construction activity <br />and prior to stockpiling or loading of coal. Specific items with regard <br />to compliance which were noted duriny our inspection include the <br />following: <br />A diversion tlitch must be constructed above the disturbed area <br />to route irrigation and storm runoff away from the loadout. <br />The ditch must r_apable of safely passing the flow resulting <br />from the 10-year 24-hour storm event without eroding. <br />2. A bean roust be constructed along the outside perimeter of the <br />pad area to prevent slough age or spillage of coal onto the <br />outslope of the bench and to nwre effectively aid in <br />containment of runoff on the benctr. <br />3. The portion of the topsoil stockpile adjacent to the railroad <br />cut should be pushed back from the cut ano a berm or diversion <br />ditch should be constructed around the pile. The exact <br />ac re aye of disturbance and topsoil volume calculations should <br />be submitted immediately to enable the Division to assess the <br />adequacy of topsoil salvage and the potential for' restoration <br />of predisturbance agricultural productivity. The absence of <br />topsoil buffer strips and presence of topsoil buried beneath <br />the fill slope along the southern side of the pad raise some <br />concern as to the adequacy of topsoil salvage. <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
