The entire affected area at the facility site is <br />somewhat less than ten acres. Terror Creek Company has used <br />particular care to ensure that the facilities area will indeed be a <br />model for the area. <br />Additional discussion by Fred Banta indicates that the Mined Land <br />Reclamation Division's current posture for these types of facilities <br />is to require that they be permitted like a surface coal mining <br />operation. In addition, the hlined Land Reclamation Division will send <br />Dan Mathews and Brian Munson to the Terror Creek site on February 2, <br />1983 for an on-site inspection of the construction activities. <br />It is important to note that the Terror Creek Company has proceeded on <br />good faith with the Division and not provided a formal permit <br />application up to this time as indicated by earlier correspondence by <br />the Division. Terror Creek Company plans to submit a formal permit <br />application as soon as possible for review by the Division and to <br />complete compliance with current interpretation of the statutes. <br />With regard to our conversations, please provide written <br />correspondence to Terror Creek Company outlining the Division's <br />current permitting requirements and time schedules which may affect <br />the construction and operations activities at the Bowie site. <br />If you have any questions please contact me or Stuart B.
