Unless pr•everrted by snovr cover, all cut and fill slopes should <br />be seeded and mulched inr~nediately to provide for vegetative <br />stabilization during the life of ttre operation. The proposed <br />final seed mixture would be acceptable for interim <br />stabilization without the three woody species and yel]ow <br />sweetclover. The topsoil stockpile should also be seeded and <br />mulched. <br />Second, a complete application for a permit must be submitted to the <br />Division, prior to further operations at the site, with the exception of <br />items 1 through 5 above. <br />Rule Z.Ob.IU. (Coal processing plants and Support Facilities Not <br />Located within the Per~riit ilrea) requires that "in addition to ... other <br />applicable requirements of these rules, the operatioru will be conducted <br />in compliance with Rule 4.z8." Rule 4.Z8 addresses operation and <br />reclamation activities, roads, sediment control, water rights, air <br />pollution control, fish and wildlife protection, topsoil and <br />re vegetation, and prime farmland. <br />Based on these requirements, the nature of the operation and previous <br />discussion between Division staff and representatives of Ter°ror Creek <br />Company, the permit application should address, to some extent, all of <br />the requirements of Rules 2.03, 2.04, 2.05, 2.06.8 and 2.06.10. Uetailed <br />information will need to be provided for pond and ditch sizing <br />calculations and reclamation costs. Hir quality and NPDES Permits should <br />be included in the application. The SCS soil description for the <br />Progresso loam should also be included in the application. <br />Based on field observation by Brian Munson and myself, analysis of areal <br />photos, and previous alluvial valley floor determinations for the (forth <br />Fork of the Gunnison; the Uivision's preliminary opinion is that the <br />Terror Creex Loadout has been constructed on an alluvial valley floor. <br />Based on information presently available, the Division would make the <br />following findings for lands within and adjacent to the permit area: <br />Unconsolidated streamlaid tleposits ho]diny streams are present. <br />2. There is sufficient water to support agricultural activities <br />as evidenced by the existence of flood irrigation in the area <br />in question. <br />If the applicant is not in agreement with the Division's informal opinion <br />that the loadout is situated within an alluvial valley floor; detailed <br />hydrologic and geologic information as specified by Rule 2.06.8(3)(b) <br />would be required. <br />
