The applicant is in compliance with the requirements of this section. <br />XIII. Fish and Wildlife - Rules 2,04.11, 2.05.6f2) and 4.18. <br />Ihformation pertaining to fish and wildlife resources may be found in Section <br />2.04.11. <br />Blue Flame contacted the local office of the Colorado Division of Wildlife <br />requesting their assistance in identifying wildlife species and assessing any <br />potential impacts the proposed mining operation may have on wildlife. This <br />information has been combined with the information provided by the Colorado <br />Division of Wildlife for the adjacent National King Coal, Inc., permitted coal <br />mine. It is the Colorado Division of Wild]ife's position that the potential <br />impact of this proposed mining operation is minimal. Reclamation of the site <br />will enhance wildlife habitat in the area. <br />.. Pursuant to Rule 2.07.6(2)(n), the Division finds, based on the available <br />information, that the proposed mining operation will not affect the continued <br />existence of any endangered or threatened species nor result in the <br />destruction or adverse modification of their critical habitat. <br />The applicant is in compliance with the requirements of this section. <br />XIV. Prime Farmland - Rules 2.04.12, 2.06.6 and 4.25. <br /> <br />The Division has made a negative determination of prime farmlands within the <br />proposed permit area. This decision was based on two criteria: there are no <br />prime farmland mapping units within the proposed permit area; and, the land <br />has not been historically used for cropland. <br />The applicant is in compliance with the requirements of this section. <br />XY, Doe rations Description - Rules 2.05.2, 2.05.3(2) and 4.01. <br />The description of the mine operations and facilities area is located in <br />SeC~ions 2.05.2 and 2.05.3. <br />The Blue Flame Coal Mine is an underground room and pillar mine that proposes <br />to mine solely the "Pueblo" coal seam of the Upper Menefee Formation. The <br />coal will be mined utili__>ing conventional mining methods with the coal <br />transported to the surface by shuttle cars. Projected annual production is <br />approximately 13,200 tons with a total five-year permit term production <br />anticipated at 66,000 tons. All coal to be mined is privately owned. <br />Once brought to the surface, the coal is screened by a shaker conveyor which <br />separates the coal into various sizes. The coal is then stockpiled in a 25 <br />ton hopper and associated storaoe bins. Two types of coal are stockpiled: <br />nuoget and fine coal. No washing or processing other than screening is <br />planned for the mine. <br />-20- <br />
