<br />Storm Ring Mines submits the following landowner's letters <br />requesting that the roads, as valuable improvements to the <br />property be retained and left open for further use. Subsequent <br />to mine development additional industrial uses and agricultural <br />uses will utilize developed roads. <br />MLR Comment: <br />"Since the access road is to be temporarily used as a haul road, <br />it must meet the standards of Rule 4.03.1 as a haul road. This <br />includes certification that the road has been constructed as <br />designed. The applicant has not committed to certification of <br />either the haul road or the access road; therefore, the following <br />stipulation is necessary: <br />Stipulation No. 9 <br />IMMEDIATELY FOLLOWING CONSTRUCTION, THE PERMITTEE MUST SUBMIT <br />A STATEMENT $Y A REGISTERED PROFESSIONAL ENGINEER CERTIFYING <br />THAT THE HAUL ROAD AND THE ACCESS ROAD, WHICH WILL <br />TEMPORARILY BE USED AS A HAUL ROAD, HAVE BEEN CONSTRUCTED AS <br />DESIGNED." <br />SRM Response: <br />Storm Ring Mines will submit a statement by a Registered <br />Professional Engineer certifying that the haul and access roads <br />have been constructed as designed within 60 days of roadway <br />completion. <br />MLR Comment: <br />"The designs of the haul road and access road meet all the <br />requirements of Rule 4.03.1 for drainage, grade, road cuts, and <br />road embankments, with one exception. The applicant has not <br />completed a structural and foundation analysis to establish <br />design standards for road embankment stability appropriate to the <br />site; therefore, the following information is necessary before <br />the Division can approve this portion of the proposed operation: <br />Requirement No. 10 <br />PRIOR TO APPROVAL OF THE HAUL ROAD AND ACCESS ROAD, THE <br />APPLICANT MUST CONDUCT AND RECEIVE DIVISION APPROVAL OF A <br />STRUCTURAL AND FOUNDATION ANALYSIS TO ESTABLISH DESIGN <br />STANDARDS FOR EMBANKMENT STABILITY APPROPRIATE TO THE SITE. <br />THE ANALYSIS SHALL BE CONDUCTED IN CONFORMANCE WITH RULE <br />4.03.1(3)(d)(vii)." <br />SRM Response: <br />
