<br />Page 5 <br />Preliminary Adequacy - Apex No. 2 <br />April 20, 1981 <br />The applicant must provide a determination of probable <br />hydrologic consequences of the proposed mining operation <br />for the permit and adjacent area with respect to the hydro- <br />logic regime and the quality and quantity of water in the <br />surface and groundwater systems under all seasonal flow <br />conditions. <br />A detailed description, with appropriate maps and cross- <br />sections of permanent entry seals and down-slope barriers <br />designed to ensure stability under anticipated hydraulic heads <br />developed after mine closure must be provided. <br />The applicant must provide "a detailed description of the <br />measures to be taken to mitigate the effects of material <br />damage or diminution of value or forseeable use of land which <br />may occur,..." as a result of subsidence. <br />In accordance with Rule 2.05.6(6)(~(i)(C), the applicant is <br />responsible for monitoring "the orientation, location, and <br />elevation of each structure within the permit and adjacent <br />area...". The application should be amended to include the <br />required monitoring for the "old ranch house" referred to <br />on page 189 of the application. <br />The subsidence monitoring program proposed in the application <br />must be amended such that the required monitoring would be <br />performed at least quarterly and that the results would be <br />submitted to the Division at least semi-annually. <br />2.06.5 If the applicant desires a variance from the requirement to <br />restore disturbed lands to their approximate original contour, <br />as is implied in the "Reclamation cross-sections" on pages <br />186 and 187, a specific request must be prepared in accordance <br />with Rule 2.06.5(2). <br />r <br />2.06.8 The following information will be required by the Division to <br />begin consideration of the extent to which the Apex No. 2 mine <br />operation might be grandfathered under the provisions of Rule <br />2.06.8(5)(a)(i); documentation of the amount of coal produced <br />in the year preceeding August 3, 1977. <br />To identify the potential AVF's that might be impacted by the <br />proposed mining operation, maps should be prepared to delineate <br />the deposits of unconsolidated stream-laid materials associated <br />with the Middle Creek and its tributary in the adjacent area <br />(to be defined for AVF investigations as Sections 9, 10, 15, <br />
