<br />Page 4 <br />Preliminary Adequacy - Apex No. 2 <br />April 20, 1981 <br />A letter of certification for the completely constructed <br />sediment pond must be provided. <br />2.05.3 9 The applicant must supply a discussion of the proposed dis- <br />posal plan for underground development waste and rock split <br />materials. Disposal of these materials at the Routt County <br />Dump is not an acceptable method. Rule 4.09 must be addressed. <br />2.05.4 The applicant must commit to acquisition of a suitable plant <br />growth medium (i.e., topsoil). <br />As mentioned above, the applicant must propose measures by <br />which the successful revegetation may be evaluated in accor- <br />dance with Rule 4.15:7; a detailed baseline vegetation study <br />with timetable must also be proposed. It is virtually impossible <br />to evaluate the proposed seedmix until the results of the site <br />specific vegetation baseline study are available. Two seedmixes <br />are presented...which does the applicant intend to use? The <br />inclusion of crested wheatgrass has previously been identified <br />as unacceptable to BLM. <br />A mulching plan must be presented. <br />The method proposed for the sealing of the mine portal must <br />be described and included in the permit application; the des- <br />cription should include a cross-section of the proposed masonry <br />seal (see also Rule 2.05.6). <br />2.05.5 A more detailed discussion of the proposed post-mining land <br />use will be required if the applicant intends to leave the <br />"operations bench" as constructed on the Trout Crekk Malley <br />bottom. <br />2.05.6 A more detailed description of the measures of the applicant <br />proposed to minimize fugitive dust and stream pollution problems <br />should be incorporated into the application. Specific areas <br />of concern are fugitive dust generated by the coal crushing <br />operation and stream and groundwater pollution <br />related to leacfiing of materials from the "operations bench' <br />constructed on the valley floor. The applicant has been notified <br />that a public objection has been filed alleging both problems <br />exist. <br />
