Page 6
Preliminary Adequacy - Apex No. 2
April 20, 1981
16, 21 and 22 of T4N, R86W,, unless the applicant defines and
justifies another); documentation of the extent to which these
areas are subirrigated must also be provided. The adjacent
area must also be mapped to show the different types of agri-
cultural lands, such as flood irrigated lands, pasture lands, and
undeveloped rangelands; this map should be accompanied by a des-
cription of the vegetative cover, in terms of production and
vegetation type, and a discussion of the potential for flood
irrigation with respect to the. regional practices in wbter sheds
of the same size.
Rule 2.10.2 The application must include a map, or maps, which clearly
delineates those portions of the permit area and adjacent
areas in which coal mining operations occurred: (1) prior
to August 3, 1977; (2) after August 3, 1977 and prior to May
3, 1978; and (3) after May 3, 1978 and prior to December 15,
1980.
A map must be provided showing the location and extent of known
workings of active, inactive, or abandoned underground mines within
the permit area. Exhibit "C" and the USGS quad sheet "Rattlesnake
Butte, Colorado" show a third portal approximately 800 feet south-
west from the Apex No. 2 portal; the known location and extent of
these underground workings must be provided for consideration of
the subsidence control plan.
Maps, plans, and cross-sections included in the permit application
must be prepared by or under the direction of, and certified by,
a qualified registered professional engineer or professional
geologist. Pe~.V.fi-6+~.~2~^-) (?) d,oe.~eo...,..,
Rule 3 Performance bond requirements will be reviewed by the Division
during the upcoming weeks. Communications with representatives
of Routt County indicate that the operator will be required to
post a $25,000 liability bond with the County to cover possible
damage to roads or other county-maintained facilities. Inasmuch
as the intent of the County liability bond and the State recla-
mation bond do not overlap, the Division does not anticipate
being able to incorporate the County bond in the requirements
for the reclamation performance bond.
