MCM 82-140 <br />ACCEPTING A t•fODIFICATION OF THF. <br />COC!DITIONAL USE PERMIT TO <br />SHERIDAN ENTERPRISES, ZNC. <br />1 <br />Whereas, the application of Sheridan Enterprises, Inc. for a <br />conditional use for railside coal loading and stockpiling in an <br />AI'-T (Agricu]Cural Forestry-Transition) 7.one on property situate <br />in Mesa County, Colorado and described as: <br />An irregular strip of land lying 8.5 feet Southwesterly <br />from the centerline of the Denver & Rio Grande Western <br />Railroad Company's I.C.C. No. 11A, between Mile <br />Post 964 plus 2214 feet at Loma, Mesa County, Colorado, <br />was granted by the Board of County Commissioners of the County of <br />14esa on October 12, 1977, modified in May of 1978; <br />Whereas, a review was held before the Board of County <br />Commissioners of the County of r-fesa on March 23, 1982 and April <br />5, 1982 which review was held after notice thereof; and <br />47hereas, Sheridan Enterprises has indicated its desire to <br />continue with said conditional use until December 31, 1984 and <br />has also indicated its willingness to work with area residents to <br />mitigate the problems associated with such use, and the Board of <br />County Commissioners having considered the needs of the <br />community, and Sheridan Enterprises, Inc. and the letter of <br />Sheridan dated April 12, 1982 seeking a modification of the <br />conditional use permit Finds: <br />1. Concern persists among those living near the facility <br />that the operation of Sheridan Enterprises, Inc. may continue to <br />produce problems. <br />2. Sheridan Enterprises, Inc. has requested modifications <br />of the conditions of its permit which modifications are more <br />restrictive than the conditions presently in effect, and which <br />modifications will reduce the impact on the Loma area. <br />3. It is in the best interests of the County to provide <br />for monitoring and enforcement of the permit and its conditions <br />and Sheridan Enterprises, Inc. has no objection thereto. <br />4. It is in the best interests of the County that the <br />modifications as suggested by Sheridan Enterprises, Inc. be <br />imposed on such permit. <br /> <br />
