Further scientific data is requested to substantiate Empire's conclusions: <br />a. The applicant states that "the permeabilities of the aquifers <br />are poor" page III-23, although the average hydraulic conductivity <br />presented for the aquifers on page III-27 ranges in the moderate <br />to moderately high range for sandstones (Rule 2.04.7(1)lbJ); <br />b. The applicant states that, "vertical movement and hydraulic <br />connection exists between aquifers, but probably is extremely <br />limited". Recently, a generous influx of water was encountered <br />in the k5 mine workings when the workings reached a fault. Data <br />from this event should be used to re-evaluate the conclusion above <br />(Rule 2.09.7(1)(bJ). <br />2.04.7(2) Surface Water <br />Z. Additional information will be needed to adequately define the <br />hydrologic balance in the permit area. The applicant must supply a plan <br />for measurement of the seasonal fluctuation in the quality and quantity <br />of water in the Williams Fork and Yampa Rivers. Specific information <br />needs to be gathered regarding flow characteristics both upstream and <br />downstream of the mine workings on both rivers. Empire Energy already <br />maintains a flow gauge on the Williams Fork at the bridge which will <br />fulfill one point of data collection. Three additional stations are <br />required - two on the Yampa and one upstream on the Williams Fork. <br />2. The surface water flow information included a statement that there <br />had been a minimum flow of zero on the Williams Fork River (Table III-18). <br />The dates of zero flow as recorded as the USCS monitoring station at <br />Pagoda should be supplied (Rule 2.04.7(2](b](i]). <br />2.09.7(3) Alternative Water Supply Information <br />1. To develop an alternative plan for water supply, the applicant must <br />identify the quality and quantity of all sources of water within the permit <br />area and the adjacent area for domestic, agricultural, industrial, Fish <br />and wildlife or other beneficial uses. This information is necessary to <br />determine if sources of water have been contaminated, interrupted or <br />diminished (Rule 2.09.7(3]). <br />2. An augmentation plan which addresses each source of water must be <br />supplied if indeed beneficial uses of water exist in the proposed permit <br />area and adjacent area (Rule 2.04.7[3]). <br />2.09.9 Soils Resource Information <br />1. The soils map, III-15, should includr_ the .lepths to which soils were <br />samples for quantity and quality (Rule 2.04.9(1]). <br />2. The applicant must map all disturbed areas within the proposed permit <br />boundary on the soils map, including the refuse disposal area, pit 6 and <br />7, corridor areas, 9A portal area and S portal area. <br />-4- <br />
