we were to operate as Sunbelt did with coal all
over the place then we would pick this up and
carry it to the sediment pond. As our mine is
set-up once the coal is mined it will stay in
concrete storage bins until loaded out for
shipment, so the coal should never hit the ground
from mining until it leaves the property to the
customer. As far as mine wastes entering the
sediment pond, this should not happen. 'The water
in the pond will contain sediment from exposed
cuts or runoff from roads. The Hay Gulch Ditch
also carries this type of sediment and is used
for stock watering. No animals in this area have
died due to drinking this water. We will commit
to complying with the State Engineer's office in
regards to this pond. The statements in regards
to the impondment will be changed on pages 4.05-7
and 4-16 and are included in this letter.
16. On his visit to the mine this week John Doerfer
and I had some discussions on the acid water that
we are making from a seep below the coal seam and
I think that we have worked out a plan between us
to build two small holding ponds beside the road
where this water can be contained and treated with
lime to bring up the PH levels.
17. We are presently looking into the drainage problems
related with getting the water from the mine bench
to the loadout area. We are thinking of installing
culvert from the mine bench to the loadout area,
with concrete inlet and outlet.
18. We will include in the mining permit our requests
for keeping the coal bins and scales after mining
is complete. Please find the needed discussion.
19. Task #4. We do not agree with this estimate and
have enclosed two bids from local contractors
that are good for three years.
Task #11. We agree.
Task #12. tde agree.
Task #14. We agree.
With the enclosed estimates we feel that the Bond
should be in the $50,000.00 area rather than the
$58,200,00 you have derived.
20. We will be glad to mulch at the rate of 4,000 lbs.
per acre. But, we have been told that being as
arid as we are in this area that nothing will
survive at the 4,000 lbs. per acre. I have no
experience at growing vegetation in this area
and I don't think the division has either, so I'm
-3-
