Enclosure 2 <br />Item 2 <br />Federal coal leases C-081251 and C-081258 are currently undergoing <br />scheduled readjustments of terms and conditions. The new lease terms and <br />conditions will be effective May 1, 1985. The permit application is <br />currently in compliance with applicable lease terms and conditions as set <br />forth in the original leases. However, the permit application does not <br />address the requirements under Section 30(b) concerning paleontological <br />resources that will be required under the readjusted lease terms and <br />conditions (see attachment). The application will be in compliance with <br />all other applicable lease terms and conditions being proposed through <br />the readjustments. <br />Some confusing information was identified in Tab 5 concerning cultural <br />resources. The map labeled Exhibit 5-1 shows different mine blocks and <br />sequence dates than what is shown in Exhibit 13-1. In addition, some of <br />the cultural resources displayed on Exhibit 5-1 are not mapped in their <br />proper locations. It is recommended that Exhibit 5-1 be corrected. If <br />this correction changes the narrative in Tab 5, another review of the <br />revised material will be required to determine compliance with lease <br />terms and conditions being proposed through the readjustments. <br />Item 3 <br />The referenced Federal coal leases were issued effective May 1, 1965, <br />prior to the establishment of unsuitability criteria. Pursuant to 43 CFR <br />3461.4-2, unsuitability criteria shall not he applied to leased lands. <br />Therefore, no lands within the referenced leases are unsuitable for <br />surface mining and reclamation. <br />Item 4 <br />The post-mining land uses do not conflict with existing or proposed land <br />management plans and policies. <br />Item 5 <br />We concur with the inadequacy items identified under the reclamation <br />section of the USFWS memorandum to your office dated March 26, 1985. The <br />Bureau also believes that Peabody's reclamation should better ensure <br />replacement of existing wildlife habitat, particularly aspen <br />re-establishment. Therefore, the reclamation plan should not emphasize <br />livestock grazing over wildlife habitat. <br />Measures to protect other non-mineral Federal resources under our <br />jurisdiction are deemed adequate. <br />
