ATTACHMENT <br />(b) Paleontological Resources - (I) Before undertaking any aNviies that <br />may disturb the surface of the knxd lands, the lessee sha0 contact the <br />Bureau of Land Managemes to de[ertnine whethv the authorized office <br />WII require the levee to conduct a paleonmlogical appraisal of the mine <br />plan and adJacent areas, ar explosdon plan areas, that may be adversely <br />dfected by leesrrcla[ed actlvitles. If the authorized officer delertnines that <br />one is necesvry, the paleontological appsivl shall be conducted by a <br />qualified paleontologirt approved by the authorized office of the surface <br />managing agency (BLfA if the wrfece is privately ovmedl. using the pub• <br />fished literature and. where appropriate, field appraivLs fordetermining the <br />povible e,artence of larger and more conspicuous fossils of sdenific signi- <br />ficance. Areport of the eppsivl and recommendatrons for protecting arty <br />larger and more conspicuous fossib of significant scientific interert on the <br />leased lands so identified shall be submitted to the authorized officer of the <br />surface managing agency (BLM if the surface is pdvately owned). When <br />necessary to proteR and collect the large and more conspicuous fossils d <br />significant scienific imvert on the leased lands. the lessee shai undertake <br />the measures provided in the approval of the mining and reclamation plan <br />or explosion plan <br />(2) The lessee shall not knowingty disturb, alter. desvoy or ske arty larger <br />and more conspicuous fossils of significant scieniflc Interest, and shall <br />protect all such fossils in conformance with Ne measures included in the <br />approval of. the mining and reclamatlon plan or explosion plan. <br />(3) The lessee shall immediately bring arty such fossils that might be altered <br />or destroyed by his opesion w the attention of the Regional Director or the <br />District Mining Supervisor, as approprtate. Operadoro may contlnue as long <br />v the fossil speamen or spedmens would not be xriously damaged or <br />destroyed fry the acivity. The Regional Director or the DistdctMlning Super <br />Nsor, as appropriate, shall evaluate or have rduated wch dixoveries <br />brought to his attentlon and, within five (5) working days, shaft notrty the <br />lessee what action shall be taken with respect to such dixoveries. <br />(6) All such fossils of significant xienific Interest shall remain under the <br />Jurisdiction of the United Slates unit ownership is determined under appli• <br />cable law. Copies of all paleontological resource data generated as a result <br />of the leax term requirements will be provided W the Regional Director x <br />the DisMCt Mining Supervisor, as appropriate. <br />(51 The cost of arty required vlvage of such fouiis shall be borne by the <br />United States. <br />(b) These conditlons appy to all wch fossils of significant xientlfic interest <br />dlxwered within the lease area whether dixwered in the overburden inter- <br />burdrn or coal xam ar xams <br />
