Mr. Thomas Wainwright -2- December 8, 1982 <br />Rule 2.03.4(7) - Identification of Interests <br />Tha permit application does not contain a statement of all lands, <br />interests in lands, options or pending bids on interests held or <br />made by the applicant for lands which are contiguous to the area to <br />be covered by the permit. Page 3-47 of the application refers one <br />to Appendix 3-1 for the information on interests in contiguous <br />lands. However, Appendix 3-1 only identifies the legal description <br />for the permit area. Therefore, a statement of all interests in <br />contiguous lands is needed to complete the application. This <br />information can remain confidential upon request and fulfillment of <br />Rule 2.07.5. <br />Buie 2.04.6(1)(x) - Geolocv <br />The geologic cross-sections (Exhibits 6-GR-1 through 6-GR-9) are <br />incomplete. These cross-sections only show the coal aeam8 to be <br />mined. No attempt was made to correlate and draft overburden and <br />underburden strata on the croea-sections. The locations of <br />sandstone, shale and siltatone unite within the overburden and <br />underburden are important in assessing the movement of ground water <br />in these strata. Therefore, the applicant should redraft and <br />resubmit geologic croea-sections of the permit and adjacent areas. <br />The geologic croea-sections should include the location of <br />lithologic strata. The applicant should also include within the <br />geologic description the prominent trend of lenticular sandstone <br />unite in the overlying and underlying strata. The submittal Of the <br />cross-sections and geologic description are required to satisfy the <br />permit requirements under Rule 2.04.6(1)(a), which requires that the <br />geologic cross-sections of the permit area describe the nature, <br />depth and thickness of each stratum down to and including the <br />stratum below the lowest coal seam to be mined. <br />Rule 2.04.7(2) - Surface Water Information <br />The applicant has not provided sufficient information to identify, <br />in detail, the seasonal variations in water quality and quantity of <br />the springs identified in the permit and adjacent area. <br />To complete the application, additional flow data and water quality <br />data (including major ions, minor ions, end trace metals) sufficient <br />to show eeaeonal variations should be provided for the springs <br />located in the permit and adjacent area. <br />
