Dear Mr. Wainwright:
The Division has received your application for a permit revision.
Our initial review indicates that several Items required by the
Colorado Surface Coal Mining Reclamation Act, C.R.S. 1973 34-33-101
e~ seg. and the regulations promulgated pursuant to the Act have not
been submitted. Thus your application has been deemed incomplete
for the purposes of filing on this date.
The completeness review identified deficiencies in the application
where required data was not submitted or insufficient information
was presented for the Division to continue the review process.
since it is the Division's intent to complete the review of the
application within the statutory time frame of 120 days, any data
gaps which exist where collection and/or analysis of data could
extend beyond the 120th day must be identified upon permit
submittal. With this Sn mind, several sections were identified as
incomplete. Seneca Coals, Ltd. may have the data currently
available which could be submitted or could prove that the data ie
shortly forthcoming to complete the application. The following
requirements must be addressed and sufficient information presented
so that the Division can progress with the adequacy review.
Rule 2.03.3(7) - Formal and Sunulemental Information
The applicant has not provided a set of Certified maps with the
original signatures. Rule 2.10.3(2) requires that maps identified
in Rule 2.10 must be pteparad by or under the direction of, and
certified by, a qualified registered professional engineer or
professional geologist. One set of maps for the public review copy
o! the permit application will need to be certified in accordance
with Rule 2.10 in order to deem the application complete.
