Shelton Page 2 <br />December 18, 1981 <br />In an effort to bring the problem to the attention of the Division, <br />Sunbelt has held a series of meetings with Division representatives <br />throughout the late summer and fall of 1981 for the purpose of <br />discussing and reaching some understanding on the permit, design <br />criteria for certain structures in the mining area, and environmental <br />baseline information requirements in a wide variety of areas. <br />We must emphasize that this permit is not for a new mine in virgin <br />country. It covers an operation that has been in existence for over 70 <br />years. Equally important, the revision does not seek to expand the <br />existing levels of production requiring greater levels of disturbance. <br />Mining will simply proceed logically in to the adjacent unmined coal. <br />The Division has significant familiarity with the Peacock Coal Mine. <br />The state has evaluated the Peacock Coal Mine thoroughly through <br />numerous inspections, field meetings, and meetings in Denver. Since <br />much of this permit covers planned and past operations, it is hoped that <br />the Division's familiarity will allow the review to progress speedily. <br />In conclusion, we hope that all these factors -- Sunbelt's critical need <br />to get its mine in operation, regulatory familiarity with ongoing <br />• operations, prior environmental disturbances and minimal net future <br />environmental impacts -- will enable you to expediently review and act <br />upon this permit. We must reiterate that without regulatory approval of <br />this revision, Sunbelt will be forced to terminate its underground <br />mining operations. <br />We know that this additional permit information will be carefully <br />scrutinized. Recognizing this, we want to maintain open lines of <br />communication.
