("Sunbelt") has a temporarily closed <br />underground coal mining operation in an area directly east of Hesperus, <br />in La Plata County, Colorado. The operation of Sunbelt consists of a <br />small room and pillar mining area known as the Peacock Coal Mine. The <br />Sunbelt operation was covered by an earlier permit application submitted <br />to the Colorado Mined Land Reclamation Division ("Division") in February <br />of 1981. This early permit was determined to be complete according to <br />the requirements set forth by the Colorado Surface Coal Mining <br />Reclamation Act, CRS 1973, 34-33-101, et sec. A letter from Mr. Mike <br />Long of the Division to Mr. S. D. Stevens indicating the initial <br />completeness is attached. <br />Accompanying this letter is additional permit information with respect <br />to the Peacock Coal Mine. This additional data is specifically directed <br />at compliance with the Colorado Surface Coal Mine Reclamation Act, <br />D.R.S., 1973, Section 34-33-101 et seg, and the recently promulgated <br />Colorado Regulations. The information has been developed under a format <br />following the Colorado Regulatory Program. The net effect of this <br />request is to allow for the continuation of coal mining at the Peacock <br />Coal Mine. <br />The Sunbelt permit for a Colorado permit must be approved in order to <br />provide a cash flow to maintain employment and to meet market needs in <br />the nearby communities. Without regulatory approval of the accompanying <br />information, Sunbelt coal production cannot continue, and its operations <br />will be forced to cease. <br />Without Colorado approval, all employees will be laid off, market <br />potentials will not be met, and, in the broader perspective, the <br />nation's critical energy shortage will be aggravated. The revision does <br />not seek to expand production above the levels previously requested nor <br />effect significantly greater levels of disturbance. Mining will simply <br />proceed logically on existing coal leases for which Sunbelt has <br />authorization to mine. <br />1 <br />~I <br /> <br />
