The applicant must submit information to <br />the Division demonstrating that the required insurance is still in effect ;; <br />or.that a new policy has been secured. • <br />2.04.4 Cultural and Historic Resource Information <br />The applicant states that, "On consultation with the State Historical <br />Preservation Office and the National Register, it has been determined <br />that there are no sites in the permit or adjacent areas which have been <br />nominated or have been determined eligible for the National Register." <br />It would be beneficial if the applicant would supply the Division with <br />a letter from SHPO verifying the above statement. <br />2.09.6(2)(a) Geology - Underground Ffining <br />The applicant z'efer ences a generalized stra ti gra phic column (figure 2). <br />The referenced figure is not contained in the application, This information <br />should be submitted for inclusion in the application. <br />2.04.6(2) Geology - Underground Mining <br />The applicant has not submitted the required Geochemistry Analysis for <br />• the roof and floor materials encountered at the mine. This information <br />is necessary to determine the potential of acid-forming, toxic-forming, or <br />alkalinity-producing materials. Roof and floor material should be sampled <br />for the parameters listed in Exhibit A. <br />Since the applicant is not proposing any surface disposal of underground <br />development waste, or any coal processing facilities there are two <br />alternatives open to the applicant. The alternatives are: <br />1. Perform and submit the required analysis; or <br />2. Request a waiver from this requirement. <br />As provided by 2.04.6(2)(b), the applicant may request a waiver from any <br />of the z'equirements of 2.04.6(2)(iii). In order for the waiver to be <br />granted the Division must be able to make a written determination that the <br />required information is unnecessary because equivalent information is <br />available to it elsewhere in a satisfactory form. Therefore, should the <br />applicant elect to pursue this alternative a request should be submitted <br />which references where the equivalent information may be obtained. <br />L <br />
