<br /> <br />I. Legal, Financial and Compliance Information - Rule 2.03 <br />There are no substantive differences between the Federal and State <br />programs in this section. However there are some changes which have <br />occurred. <br />State stipulation 1 required the applicant to submit the required number <br />of corrected copies of the permit application within 60 days. The <br />Division has two complete copies on file, which is adequate for our <br />purposes; one for the public to review and one for the lead reclamation <br />specialist. In future submittals CYCC should submit three co ies of <br />information. One copy for each of the previously listed rocess"and also <br />a copy for the file or technical staff to review. <br />State stipulation number 4 required the applicant to incorporate all <br />conditions from previous permits on Energy Mines No. 1 and 2. This has <br />been satisfactorily resolved. <br />Since the permit was approved there have been several revisions which <br />changed the number of permitted acreage and the permit boundaries. Pmong <br />these are the bond release at Energy Mine No. 2, the revision in Area <br />9/10, the area 60 revision and the Foidel Creek permit revision {romi.ng <br />the-m.i.nes-are-separa~edj.. F-,.itw-rL,. <br />The Energy No. 1, 2 and Eckman Park mines are permitted and operated by <br />the Colorado Yampa Coal Company (formerly Energy Fuels Corporation) a <br />subsidiary of Getty Oil Company. Currently, they are in the process of <br />completing the requirements of Rule 2.08.6, Transfer, Assignment of Sal <br />of Permit Rights. In addition CYCC is requesting a separate permit for <br />the Foidel Creek underground mine, which is operated by another Getty Oil <br />Company subsidiary, The Twentymile Coal Company. The Foidel Creek mine <br />is developed in the last pit of the Energy No. 1 mine. Some surface <br />facilities are shared by both mining operations, such as Ponds D and Gin <br />the sediment control system. Assuming the permits are separated during <br />the transfer process, it must be clear in permit No. 79-177 which company <br />is responsible for the maintenance of all shared facilities. Also, if the <br />permits are split the permit boundary of the Energy No. 1, 2 and Eckman <br />Park mines will have to be revised as stated above. <br />With a revised legal permit boundary description and map, this section <br />will be in compliance. <br />II. No concerns have been identified in regard to land-use thus far <br />in the permit term. <br />This section is in compliance. <br />
