<br />-z- <br />-~ <br />IIi. Cultural and Historic Resources - Rule 2.04.4, 2.05.6(4) <br />There are no substantive differences between the Federal and State <br />programs in this section. However, during the permit review process <br />several concerns arose in regard to cultural and historic resources. As <br />a result the OSM attached five stipulations to the approval package. <br />These were: <br />17. If, during mining operations, previously unidentified cultural <br />resources should be discovered, the operator shall immediately <br />cease operations within the vicinity of the site and notify the <br />regulatory authority. Operations shall not reswne until OSM, the <br />land managing agency, and the State Historic Preservation Officer <br />have had adequate opportunity to assess the cultural resource. <br />Mining operations shall not resume until appropriate mitigating <br />measures have been developed, approved, and implemented. <br />18. Within 60 days after mine-plan approval, the operator shall <br />fence the historic grave which is unfenced. In addition, no land <br />disturbing activities shall take place within l0U feet of the two <br />known graves on the permit area. <br />19. The operator shall keep the fence sur <br />Canyon School in good repair. Agate must <br />the road leading to the school to prohibit <br />area. Site 5RT192 must also be recorded on site forms <br />approved by the Colorado State Historic Preservation Officer <br />(SHPO). The nomination forms will be completed by a professional <br />historian who meet with the approval of the regulatory authority <br />and the SHPO. <br />21. Within 120 days after the approval of the mine plan, the <br />operator shall develop and submit for approval a preservation plan <br />for Foidel Canyon School (5RT192) to the regulatory authority and <br />to the Colorado State Historic Preservation Officer, and Advisory <br />Council on Historic Preservation. <br />Those stipulations that require responses have been addressed and <br />stipulation 17 does not require a response. The operator has constructed <br />the fences required by 18 and 19 and they observe the no disturbance <br />areas. Responses to stipulations No. 20 and 21 were received on June 26, <br />1980 and July 26, 1980, respectively. Foidel Canyon School has been <br />listed on the National Register of Historic Places as of May 9, 1983. <br />This section is in compliance. <br />
